Adoption Eligibility Basics: Who May Be Adopted?

The adoption of a child is permitted in every state. In some states, the adoption of an adult is allowed (under certain circumstances). Arizona is one of six states that require that the child to be adopted must be present in the State at the time the petition is filed. Arizona Rev. Stat. § 8-102 outlines the eligibility requirements of who may be adopted in the state of Arizona.

Who May Be Adopted According to Rev. Stat. § 8-102

  • A child
  • A person born outside of the U.S. aged 21 or less (who is not an illegal alien)
  • The individual being adopted must be present in the State at the time that the petition is filed.

The following statistics were gathered from the Arizona Department of Economic Security’s “Child Welfare Reporting Requirements Semi-Annual Report for the Period of April 1, 2014 through September 30, 2014.

  • The number of children in out of home care increased from 15,751 to 16,990.
  • 33.5% of children in out of home care in The State of Arizona are between the ages of 1-5.
  • 83% of children in out of home care in the State of Arizona are there due to neglect.
  • 52% of children in out of home care spend 31 days to 1 year in foster care before returning home or being placed with an adoptive family.
  • 7% of children aged out of the system.

Many who wish to adopt a child, but haven’t yet looked into the process thoroughly, assume that there are not children available for adoption. This is not a surprising assumption due to the length of the process and the difficulty they may have seen others go through in their search to adopt a child. What isn’t clear without a further understanding of adoption law and the adoption process, is that adopting a child takes time. The delay between starting the adoption process and actually adopting a child is not due to a lack of children in need of homes. There are many children in the foster care system right now hoping to be placed with an adoptive family.
