The Do's and Don'ts of Divorce

The Do's and Don'ts of Divorce

It is no secret that divorce can be a confusing and emotional experience. Dealing with the breakdown of your marriage is never an easy task, especially if you and your soon-to-be ex-spouse are unable to see eye to eye regarding the terms of your separation. As tensions rise, it can be easy for divorcing spouses to lash out at each other or engage in uncharacteristic behaviors. While each person will react differently, it is important to remember to stay in control of your actions and maintain a good standing with the court. In fact, your actions during this time can have a considerable impact on the overall outcome of your divorce settlement.

The following do’s and don’ts can help you minimize conflict and possibly avoid costly pitfalls during your divorce:

  • Do not act violently or unnecessarily hostile towards your spouse. This will only serve to worsen your situation and give them more leverage during settlement negotiations – or even worse, cause you to end up with criminal charges.
  • Do think before you act. If you do not want a Judge to find out about it, don’t do it!
  • Do not violate any custody or visitation orders. Disrespecting the Court’s wishes could cause you to end up being charged with contempt of court and cause you to be viewed in an unfavorable light.
  • Do attend all Court hearings and appointments on time.
  • Do not attempt to hide assets from your spouse. Using dishonest tactics to hide or temporarily transfer them to a friend could cause you to wind up in Court again or be penalized.
  • Do consider your children’s feelings and their wellbeing during this time. While you may not see eye to eye with your spouse anymore, maintaining an amicable relationship may be a great gift to your children.
  • Do not withhold pertinent information or lie to your attorney.
  • Do make an effort to take care of yourself during this time. Spend time with those you love, seek professional help, and avoid any unhealthy habits during this time.
  • Do not dwell on the complexities of your divorce or discuss it with anyone other than your legal counsel. Be sure to keep it separate from your daily life.
  • Do allow yourself to take time to de-stress. Relax and do things that make you happy.
  • Do not use your children as a means of getting back at your spouse for some prior misdeed. Their wellbeing is far more important than any vengeance you may feel the need to pursue.

While these tips may help you pursue a smooth resolution, it is important to remember that no two divorces are alike. As such, it is imperative you retain the services of a knowledgeable attorney to ensure your interests are guarded during this time of transition.
