Adoption as a Stepparent or Relative

Stepparents, grandparents, and relatives often feel very strongly about the health and well-being of the children in their extended families. When a child's parents step out of the child's life, family members often wish to step in and arrange for an adoption. Relative adoptions can be a complex process. If not done correctly, your adoption can be subjected to massive delays. It is important that you speak to our skilled adoption attorneys at Arizona Family Law Attorneys to help ensure that the process stays on track.

How Does Step Parent Adoption Work?

If you're looking to adopt your stepchild, the process generally involves:

  • A Consultation with an Adoption Attorney: Your adoption attorney will be able to discuss the adoption laws with you and how they apply to stepparent adoptions
  • Consent to Adopt: generally, both birth parents must give their consent for the adoption to occur
  • Consent of the Child: nearly all states require that a child give consent to adopt once they pass a certain age
  • Submit Legal Forms: your adoption attorney will prepare the necessary legal forms and submit them as necessary
  • Wait for Your Court Date: you will receive a notification of a court date either by letter or through your attorney that you must attend
  • Your Hearing: at the hearing, the adoption is finalized when the adoption certificates are issued.
  • Apply for an Amended Birth Certificate: once the adoption is finalized, apply for an amended birth certificate at which point you can complete name changes and update parent info, etc.

How Our Phoenix Family Lawyers can Help

Our firm’s stepparent and relative adoption attorneys have extensive experience helping family members adopt their relatives. When you contact our law firm, one of our lawyers will meet with you in person to discuss your case. If your adoption will take the child across state lines, we work with the Interstate Compact on the Placement of Children (ICPC) office to get permission to move the child into or out of Arizona. The ICPC calls for strict deadlines, and your adoption can be severely delayed if you fail to meet the requirements.

As our client, you may also benefit from the following:

  • If you ever have any questions about your case, we will be on hand to provide customized legal advice.
  • Our law firm moves very quickly to ensure that all paperwork is completed properly and all deadlines are met, especially when it comes to interstate adoptions.

Handling the Termination of Parental Rights

Before a relative can adopt a child, we must first terminate the rights of one or both of the child's current parents. When the biological parents consent to the termination, this process is usually fairly straightforward. If a biological parent contests the termination, however, it can become difficult or impossible to complete the adoption. As your law firm, we will guide you through the entire process, providing clear, straightforward legal advice every step of the way.
